To make provision to amend or change the Part 7 of the 1996 Housing Act in regards to intentional homelessness.

Policy Objectives of the Proposed Order

Since its introduction, the concept of intentional homelessness has proven very controversial and extremely difficult for Local Authorities to prove.  However, classifying individuals as intentionally homeless often contributes to increased social exclusion and poverty instead of dealing with the causes of the problem.  This is particularly prevalent in young people.

The Order will:

  • End intentional homelessness for those under 25 years of age as done in Scotland and as recommended by the National Assembly for Wales Social Justice Committee’s review on Youth Homelessness.
  • Give Local Authorities the power to investigate intentional homelessness as opposed to the current duty.
  • Increase support and opportunities to households that are found intentionally homeless to find suitable accommodation and/ or to re enter social rented accommodation.

This Order will be require amendment of Schedule 5 Field 11 of the Government of Wales Act.
